The Supreme Court retirement clock is ticking: Byron York

Washington Examiner chief political correspondent Byron York suggested that Supreme Court justices considering retirement should not assume Republicans will be able to confirm judicial nominees indefinitely. Weighing in on the speculation surrounding possible retirements from the court, York said he has no direct knowledge that any justice is preparing to step down. “I don’t have […]
Anthony Constantino, the CEO of Sticker Mule, won his primary race on Tuesday against the Republican Party-endorsed candidate, Assemblymember Robert Smullen.

What Washington Examiner chief political correspondent Byron York calls the “Trump effect” could determine the outcome of the midterm elections, for better or for worse. “Almost everything in the past eight years can be described in terms of Donald Trump, and I think that this Democratic turnout increase is a Trump effect,” York said on […]
Mayor Zohran Mamdani may be the new kingmaker of New York City politics. In a sweeping affirmation of his affordability-focused agenda, all three congressional candidates endorsed by Mamdani in a set of contested Democratic primary elections declared victory Tuesday night. Manhattan and the Bronx’s Darializa Avila Chevalier and Brooklyn’s Claire Valdez and Brad Lander were all joined on the campaign trail by the progressive NYC mayor in the weeks leading up to election night. Like Mamdani, Avila Chevalier and Valdez are members of the NYC chapter of the Democratic Socialists of America, which backed their campaigns.
We speak to John Tarleton, editor-in-chief of the New York City local independent newspaper The Indypendent, about the insurgent left of the Democratic Party and the potential national ramifications of the Zohran-DSA machine. The races also functioned as a referendum on the growing split in the Democratic Party over Israel/Palestine. While the pro-Israel lobbying group AIPAC funneled an estimated $50 million into their opponents’ campaigns, Valdez, Avila Chevalier and Lander refused to take any funding from pro-Israel groups and consistently emphasized their support of efforts to restrict U.S. military aid for Israel. “If you ignore the Palestinian cause of Palestinian liberation, you do so at your own peril,” says Tarleton.
Today is Election Day in New York, with a number of primary challengers hoping to unseat Democratic establishment politicians. The Democratic Socialists of America (DSA) have a packed slate of 10 candidates across congressional, state Assembly and state Senate races. “People are really looking for something else other than these corporate Democrats,” says Liza Featherstone, author and columnist for Jacobin. Describing the DSA as a key part of the “grassroots base” of the left wing of the Democratic Party, Featherstone says DSA members want elected leaders who have come out of movements themselves, not just lifelong politicians who only turn to movements for endorsements every four years.
Palestine is a key issue in many of the races, with DSA challengers taking a strong stand against genocide, while some incumbents have received large donations from AIPAC-linked super PACs. “People are absolutely disgusted with the U.S. relationship with Israel, absolutely appalled by the killing that we’ve seen,” says Featherstone. Today’s primary results will show to what extent the DSA is seen as a genuine alternative to the establishment wing of the Democratic Party.
1. Brown v. Board of Education, 1954This school desegregation decision was so important that Chief Justice Earl Warren made sure the judges were unanimous. And even with that, 20 or so years passed before it was actually enforced.2. Dred Scott v. Sandford, 1857A shameful decision not to extend citizenship to descendants of slaves by a shameful court that helped precipitate the Civil War. Let us note, however, that the vote was 7–2, so bravo to Benjamin Robbins Curtis and John McLean.3. Marbury v. Madison, 1803In which Chief Justice John Marshall established judicial review—giving the court the power to declare a congressional law unconstitutional. Would be lovely if we could undo this today.4. Plessy v. Ferguson, 1896The infamous “separate but equal” ruling. Homer Plessy was seven-eighths Caucasian and tried to sit in a white railway car. Not in Louisiana, bub!T-5. Citizens United v. Federal Election Commission, 2010A disgraceful ruling to all but undo campaign finance rules. Its impact on U.S. elections has been corrupting beyond our ability to count—quite literally, since one result of this decision is that we have no way of tracking how much corporations pour into campaigns.T-5. Roe v. Wade, 1973The landmark pro-abortion ruling. Interestingly, at first, the Jerry Falwells of this country weren’t up in arms about this one. Homeschooling was their big issue at the time.“This case … empowers Trump to violate as many laws as he wants without fear of the consequences. Immunity breeds impunity.”—author and columnist Jonathan Alter on Trump v. U.S.7. Trump v. United States, 2024The ruling that offered the president immunity from criminal prosecution for official acts. One of the most annoying naïve-liberal guessing games of the Roberts court era: Maybe Gorsuch or Kavanaugh will save us here! No. They didn’t.8. Bush v. Gore, 2000The race to the right-wing gutter started here, with a decision so rancidly political—it settled a dispute over vote recounting—that the five majority justices noted it was “limited only to the present circumstances,” i.e., meant to install George W. Bush as president.T-9. McCulloch v. Maryland, 1819Unlike Marbury, this John Marshall ruling suits liberals today just fine: It declared the supremacy of federal over state law and would define the potential scope of the administrative state. Some conservatives would like to overturn it. At the rate we’re going, they won’t need to.T-9. Obergefell v. Hodges, 2015A rare victory for progress and decency in the modern era, thanks to Anthony Kennedy joining the court’s (then) four liberals to legalize same-sex marriage.T-11. Dobbs v. Jackson Women’s Health Organization, 2022Another Deep South case, and wham, nearly a half-century of pro-abortion rights precedent tossed out the window. Every justice who voted for this clearly lied about their beliefs at their confirmation hearings.T-11. West Coast Hotel Company v. Parrish, 1937The famous case in which the anti–New Deal Supreme Court, perhaps brushed back by FDR’s court-packing scheme, shifted its right-wing gears and held that a minimum wage was constitutional. Justice Owen Roberts called it “the switch in time that saved nine.”T-11. Baker v. Carr, 1962One of three “one person, one vote” cases decided by the Warren court in the early 1960s. Warren, upon retiring, called these cases the most important of his tenure. One justice had a nervous breakdown during deliberations.T-14. Loving v. Virginia, 1967The court here held unanimously that the marriage between the appropriately named Richard Loving, a white man, and his Black wife, Mildred Jeter, could stand.T-14. Miranda v. Arizona, 1966The bane of cops from the day it was decided, it ensured that people under arrest were made aware of their rights. Kind of amazing it hasn’t been reversed yet.
When some politicians are inconvenienced by the Constitution, they may seek to change the court that interprets it. Packing the Supreme Court was once agreed to be a radical measure, one that threatens the sanctity of the institution as a politically impartial branch. For over 150 years, Congress has not altered the number of justices […]
House Speaker Mike Johnson (R-LA) is set to meet with House Budget Committee Republicans Wednesday, an important meeting that comes as Republicans race against the clock to advance a third party-line spending bill. Republicans only have seven working days left before the House leaves for a weeklong recess for the 4th of July. Upon the […]
The Democratic Party is undergoing a hostile takeover by democratic socialists — as evidenced in New York's primaries on Tuesday where Democrat establishment-types suffered humiliating defeats at the hands of radicals cut from the same cloth as New York City Mayor Zohran Mamdani. With over 90% of the votes in on Wednesday morning, incumbent Rep. Daniel Goldman trailed former NYC Comptroller Brad Lander 65.8% to 34% — a whopping 31.8 percentage points.'We are Westerners fighting for the total eradication of Western civilization.'Lander was endorsed by Mamdani, Sen. Bernie Sanders (I-Vt.), Sen. Elizabeth Warren (D-Mass.), and the Working Families Party, and ran largely to the left of Goldman, heir to the Levi Strauss fortune.Goldman — who was endorsed by AIPAC, Gov. Kathy Hochul, and House Minority Leader Hakeem Jeffries — did his apparent best to join his opponent, who is also Jewish, in criticizing Israel and virtue-signaling to radical would-be voters, but his best was nowhere near good enough. After getting steamrolled at the ballot box, Goldman told supporters, "The voters of New York’s 10th Congressional District have spoken, and while this is certainly not the outcome I hoped for and worked so hard for, I respect their decision."RELATED: CNN data analyst stunned by Democratic Party's takeover by Mamdani's fellow travelers Brad Lander and Mayor Zohran Mamdani. Spencer Platt/Getty Images.President Donald Trump weighed in on Truth Social, writing, "Weak and pathetic Congressman Dan Goldman just lost, BIG! I guess people didn’t like him illegally targeting President TRUMP. In any event, this jerk is finally GONE!"Rep. Adriano Espaillat, the five-term Democrat who leads the Congressional Hispanic Caucus, also lost to a Mamdani-backed radical, democratic socialist Darializa Avila Chevalier.Chevalier is a black identitarian who co-founded Columbia University Apartheid Divest, a radical coalition that posted "death to America" on social media earlier this year; stated, "We are Westerners fighting for the total eradication of Western civilization"; and asked for "community and instruction from militants in the Global South, who have been on the frontlines in the fight against tyranny and domination which undergird the imperialist world order."'NEVER be a communist Country!'In addition to her involvement with the international intifada, Chevalier helped advance the Columbia rape hoax and made headlines for advocating against all deportations, claiming, "Israel doesn't exist," and demanding a "world without prisons or police." She was backed by Mamdani, the local Democratic Socialists of America chapter, and Justice Democrats PAC.With 88% of the votes in, Chevalier leads Espaillat — who enjoyed endorsements from Hochul, Jeffries, and New York Attorney General Letitia James — 49.4% to 45.9%.Espaillat endorsed Mamdani for mayor last year.Claire Valdez, a Mamdani-backed democratic socialist member of the New York State Assembly, won her primary race for Democratic incumbent Rep. Nydia Velazquez's seat, beating the Democratic establishment's apparent preference and Velazquez's desired successor, Brooklyn Borough President Antonio Reynoso.Valdez campaigned on abolishing U.S. Immigration and Customs Enforcement, "demilitar[izing] the border," making it easier for illegal aliens to gain lawful permanent residence, defunding Israel, and super-charging the "Green New Deal." Like the other radicals, she also enjoyed support from Sanders, Justice Democrats PAC, and the DSA.Following the Mamdani-backed candidates' clean sweep, Trump wrote, "America the Beautiful will NEVER be a communist Country!"Like Blaze News?
