President Donald Trump's Department of Justice floored a former federal prosecutor after a grand jury witness blew up one of its signature cases. On Monday, reports revealed that a grand jury witness admitted the Lincoln Memorial Reflecting Pool was damaged before the prosecution of David Hearn, a former Olympic canoeist who was arrested and charged with felony damage to property after he touched some of the peeling paint in the pool. The admission undercuts the Trump administration's claims that Hearn was responsible for damaging the pool. Hearn's lawyers slammed the indictment in a letter on Tuesday, arguing that the Trump DOJ prosecutors acted improperly. Those claims caught the ear of former federal prosecutor Glenn Kirschner. He argued in a new podcast that the case seemed destined to go the same way as the prosecutions against former FBI Director James Comey, New York Attorney General Letitia James, and the Broadview Six, all of which were dismissed by judges for prosecutorial misconduct. "You may find this shocking, but Donald Trump's dirty DOJ officials, including Jeanine Pirro, may have again been involved in prosecutorial misconduct," Kirschner said. "Here they go again!" he added.

Prominent conservative Matt Walsh lashed out at Republican lawmakers Tuesday over what he called their “staggering betrayal,” and endorsed an extraordinary theory that Republican lawmakers were actually hoping to lose the upcoming midterms.Walsh was responding to a social media post on X published by a popular right-wing account using the pseudonym “FischerKing,” one that outlined the outlandish theory.“A significant number of GOP Senators and House members would probably like to lose the midterms – so they can back off issues like immigration (which is not popular with many of their donors) and go back to loud complaining on TV, pretending to be responsive to their voters,” reads the post from “FischerKing.”Walsh, a controversial figure in politics, concurred with the assessment, calling it “undoubtedly true.”“The Republican Congress has done virtually nothing of significance,” Walsh wrote in response. “A staggering (though predictable) betrayal.”Walsh’s bleak prediction comes amid growing fears among conservatives about the midterms, with there being a significant enthusiasm gap between Democratic and Republican voters heading into November.Another prominent conservative figure, Robby Starbuck, also sounded the alarm over what he perceived as GOP lawmakers’ failures to deliver on conservative priorities.“Some of the hardest core activists I know have told me they’re sitting out as of now. They feel all their efforts have been spit on by a Congress that won’t pass big legislation like the SAVE America Act,” Starbuck wrote in a social media post on X, referring to President Donald Trump’s controversial voter ID bill.“Many in the base feel lied to about a number of policy issues that should be no-brainers for Congress and many of them want more deportations too. If we want to win the midterms, Congress better get busy on the landmark legislation front if they hope to shift the narrative. Dems will be rabid voters this cycle.”Walsh has a long history of making controversial statements. In a since-deleted blog post, he called “adolescence” a “modern innovation,” part of an apparent argument for normalizing teenage pregnancy, Media Matters previously reported. The Department of Justice’s own witness is undermining its case against David Hearn, the former Olympic canoeist charged with vandalizing and damaging the Lincoln Memorial Reflecting Pool.According to court documents, a grand jury witness for the government said that the pool was damaged before Hearn even approached it. NBC News reports that this witness was the only person who testified about damage to the pool.Hearn, who has pleaded not guilty, maintains that “the condition of the Reflecting Pool was the same after I stepped away from the water as it was before I got there,” and that he only touched a part of the pool’s detached coating. President Trump claims that vandals used a knife or blade to cause a “gash” in the pool’s lining, but has no evidence to back up his claim.Hearn has been charged with destruction of property, a felony, and accused of causing $1,000 worth of damage to the pool. His lawyers question the evidence behind that claim, noting that the alleged cost is the necessary threshold to charge him with a felony. At least three other people have been charged with misdemeanors related to incidents at the pool.Hearn’s lawyers said that the government’s main witness testimony “established that the pool had substantial preexisting damage requiring repair before any alleged conduct by Mr. Hearn.”“The government’s only witness on that element testified that the property was already deteriorated, that the identified repairs would have been needed even without Mr. Hearn’s alleged conduct, and that he could not quantify any loss caused by that conduct,” they continued. “Consequently, the grand jury’s indictment of Mr. Hearn is hard to explain. Mr. Hearn needs to learn whether the grand jury was properly instructed that the charge required him to have caused over $1,000 in damages, when the testimony failed to establish that he caused any damage at all. So does this Court.”It would seem like the government’s case may soon fall apart, just like the pool lining, which was likely damaged by President Trump in the first place.
