New Don Lemon court filing alleges federal officer lied to the judge

A new court filing from ex-CNN host Don Lemon was filed Wednesday, alleging that a Department of Homeland Security officer lied under oath in a statement to the judge in his case. Lemon is included with several other journalists charged by the Department of Justice, which claims that Lemon and other reporters were protesting when they were filming at a Minnesota church where one of the pastors was coordinating with immigration agents. National security expert Marcy Wheeler noted that this is the second time the Justice Department has asked Judge Douglas Minko to accept a complaint from an ICE agent who watched the video of the church broadcast and testified to what was in it. According to Lemon's filing, the agent made false claims about the journalists joining in the chanting from protesters. "That sworn allegation about Mr. Lemon was false," the filing states. "The government did not produce the draft complaint affidavit until July 17, 2026. At the July 24 hearing, the government explained that it submitted the affidavit to the Court in late January, but the Court did not sign it. The government then 'took Chief Judge Schiltz's advice' and obtained a grand jury indictment on January 29, 2026. Thus, only two days before securing the indictment, the government submitted a complaint affidavit falsely alleging that Mr. Lemon and the other journalists joined in the chanting. The timing strongly suggests that the government presented the same false account of the journalists' conduct to the grand jury."On Friday, in a rare move, Judge Minko ordered that the Justice Department turn over all testimony and evidence presented to the grand jury at the time. Their specific request is to find whether this sworn statement and any others were used to secure a grand jury indictment.The proceedings for a grand jury are typically kept secret, but in recent events, judges have allowed that information to be released to the defense in trial courts. In a recent Chicago case, the Justice Department was found to have misled the grand jurors and even dismissed jurors that they felt wouldn't give them the indictment they sought. That case involved six political leaders and activists protesting outside of an ICE facility in Broadview, Illinois. The charges have been dropped and the accused have asked for a special counsel to investigate the incident. Judge Minko said that he wanted to examine the information himself first. However, Matthew Ebert, who represents freelance journalist Georga Fort, said that the government has made false claims about his client already, including in sworn affidavits, Minneapolis Public Radio reported last week. “The presumption of regularity has collapsed,” Ebert said.Justice Department prosecutor Neville Hedley told the judge that no false information in earlier documents made it into the indictment. That doesn't indicate whether the information was revealed to the grand jury to obtain the indictment, however. “These were not material falsehoods," Hedley said. “This was a mistake, this was a miscommunication.”The affidavit signed by DHS-ICE Special Agent Timothy Gerber reads, "Broadcast video obtained from Cities church also shows ARMSTRONG, ALLEN, LEMON, RICHARDSON, KELLY, FORT, LUNDY, CREWS chanting with agitators and obstructing parishioners' path of travel."Hedley didn't indicate what was "miscommunicated" in the claim. Lemon and his attorneys have alleged that the case against him and the journalists is "weak."

75+ Groups Call on Congress to Reject Weak CO2 Pipeline Safety Package

As Congressional leaders prepare to negotiate a final pipeline safety reauthorization package, more than 75 national, state and local organizations urged Congressional leaders to reject any legislation that fails to meaningfully protect communities from the rapid expansion of carbon dioxide pipelines. The groups warn that the current proposal leaves in place significant safety gaps unaddressed despite years of warnings following a 2020 pipeline rupture in Satartia, Mississippi. The pipeline buildout is backed by what the U.S. Treasury estimates will be nearly $70 billion in industry tax credits authorized in the “One Big Beautiful Bill” that passed last year. While Congress is considering legislation in the name of pipeline safety, the coalition points out the current legislation fails to establish minimum protections for communities and first responders that are necessary before the industry is allowed to build tens of thousands of miles of new carbon dioxide pipelines. The letter also points out that the administration is actively weakening existing pipeline safety oversight and enforcement, making all pipelines less safe.The letter comes as Congressional leaders must reconcile differing pipeline safety bills that passed through House and Senate Committees, and the White House is cutting oversight and enforcement for pipeline safety across the board.“Congress is telling communities to shoulder all the health and safety risks while pipeline companies are making off with billions in taxpayer dollars. Communities deserve more than empty promises about stronger rules at some point in the future. If lawmakers are serious about pipeline safety, they should stop drafting bills to benefit the pipeline companies and start drafting them for people who have to live with the consequences of these dangerous projects,” said Jim Walsh, Policy Director, Food & Water Watch."There’s no pipeline safety when the regulations are drafted by the oil and gas industry. For decades, fossil-fuel infrastructure including pipelines have dictated lifespans across Black, Brown, Indigenous, and low-income neighborhoods, exposing these communities to higher rates of disease and early mortality. As the Trump Administration dismantles more and more safeguards, we will see even more chronic illnesses and dangerous pipeline disasters that harm our neighbors and families. Congress must pass comprehensive pipeline safety standards that actually safeguard people’s lives and livelihoods — not cut corners for industry profit," said Mar Zepeda, Legislative Director at Climate Justice Alliance.“Landowners should not be criminalized for protecting their private property rights,” said Emma Schmit, Bold's Pipeline Fighters Organizing Director. “Farmers who have been waiting on federal regulations for years now should not be forced to accept potentially deadly CO2 pipelines on their farms through eminent domain. Without any adequate federal rules, the industry is plowing forward seeking state authorizations for dangerously unregulated projects while keeping the public in the dark with regard to the full scope of potential risks.”

A political operative sounded the alarm on a Supreme Court justice whom he believes is President Donald Trump's chief enabler.During an episode of Court of History, journalist and former senior Clinton White House advisor Sidney Blumenthal explained the thinking behind a recent article he wrote for The Guardian about Supreme Court Justice Brett Kavanaugh."When you look beneath the surface, and you see certain dissents and statements and opinions, you find that Kavanaugh is playing an instrumental key role on Trump's key issues," Blumenthal said. "And he's really the most politically attuned, the one who is acting most like a political operative, and the results are catastrophic."Blumenthal said that Kavanaugh has aligned himself with Trump's agenda when it comes to immigration, birthright citizenship and "damaging" tariffs.He pointed to Kavanaugh's concurrence that let immigration agents stop people based on factors including ethnic appearance, speaking Spanish, and working certain jobs, which Kavanaugh called "a relevant factor" and "common sense." The tactics later became known as "Kavanaugh stops," Blumenthal noted.When Trump appealed a decision that blocked his tariffs, the Supreme Court sided with a lower court decision that called Trump's claims "unconstitutional," Blumenthal said. "Kavanaugh, however, said, Well, not only is it not unconstitutional, let me suggest certain laws and other kinds of citations of tariffs that you could cite" to get around laws stopping Trump's tariffs."He was playing the staffer to Trump," Blumenthal said. "And then Trump attacked the majority on the court as fools and dogs. But then he said, 'Kavanaugh, I'm so proud of him.'"Blumenthal then pointed to Kavanaugh's "masterpiece of errors, factual revisionism and sophistry" on birthright citizenship, saying the justice built his case on speculation about what the framers of the 14th Amendment would have wanted."This is mind reading in a time machine about a non-existent legal category projected forward," Blumenthal said. "This is a fantastical fiction."
