New Don Lemon court filing alleges federal officer lied to the judge

A new court filing from ex-CNN host Don Lemon was filed Wednesday, alleging that a Department of Homeland Security officer lied under oath in a statement to the judge in his case. Lemon is included with several other journalists charged by the Department of Justice, which claims that Lemon and other reporters were protesting when they were filming at a Minnesota church where one of the pastors was coordinating with immigration agents. National security expert Marcy Wheeler noted that this is the second time the Justice Department has asked Judge Douglas Minko to accept a complaint from an ICE agent who watched the video of the church broadcast and testified to what was in it. According to Lemon's filing, the agent made false claims about the journalists joining in the chanting from protesters. "That sworn allegation about Mr. Lemon was false," the filing states. "The government did not produce the draft complaint affidavit until July 17, 2026. At the July 24 hearing, the government explained that it submitted the affidavit to the Court in late January, but the Court did not sign it. The government then 'took Chief Judge Schiltz's advice' and obtained a grand jury indictment on January 29, 2026. Thus, only two days before securing the indictment, the government submitted a complaint affidavit falsely alleging that Mr. Lemon and the other journalists joined in the chanting. The timing strongly suggests that the government presented the same false account of the journalists' conduct to the grand jury."On Friday, in a rare move, Judge Minko ordered that the Justice Department turn over all testimony and evidence presented to the grand jury at the time. Their specific request is to find whether this sworn statement and any others were used to secure a grand jury indictment.The proceedings for a grand jury are typically kept secret, but in recent events, judges have allowed that information to be released to the defense in trial courts. In a recent Chicago case, the Justice Department was found to have misled the grand jurors and even dismissed jurors that they felt wouldn't give them the indictment they sought. That case involved six political leaders and activists protesting outside of an ICE facility in Broadview, Illinois. The charges have been dropped and the accused have asked for a special counsel to investigate the incident. Judge Minko said that he wanted to examine the information himself first. However, Matthew Ebert, who represents freelance journalist Georga Fort, said that the government has made false claims about his client already, including in sworn affidavits, Minneapolis Public Radio reported last week. “The presumption of regularity has collapsed,” Ebert said.Justice Department prosecutor Neville Hedley told the judge that no false information in earlier documents made it into the indictment. That doesn't indicate whether the information was revealed to the grand jury to obtain the indictment, however. “These were not material falsehoods," Hedley said. “This was a mistake, this was a miscommunication.”The affidavit signed by DHS-ICE Special Agent Timothy Gerber reads, "Broadcast video obtained from Cities church also shows ARMSTRONG, ALLEN, LEMON, RICHARDSON, KELLY, FORT, LUNDY, CREWS chanting with agitators and obstructing parishioners' path of travel."Hedley didn't indicate what was "miscommunicated" in the claim. Lemon and his attorneys have alleged that the case against him and the journalists is "weak."

A two-year investigation identified 47 adults accused of sexual misconduct against students at a Michigan arts institution with deep ties to Jeffrey Epstein, drawing on more than 70 firsthand accounts of abuse dating back to the 1950s, MLive reported Tuesday night.Epstein has a well-documented history with Interlochen Center of the Arts, having attended the institution in 1967 when he was around 14 years old. In the 1990s, Epstein became a major donor to the institution, and previous reporting has revealed how he and his accomplice Ghislaine Maxwell used the center to target young girls. Recent reports also revealed that Epstein had set up his own lodge at the institution, and was accused by the mother of soap opera actress Nadia Bjorlin of trying to groom her daughter when she was 13.Carried out by Sanghavi Law Office at the behest of the institution, the new investigation revealed that the scope of abuse was far greater than previously known, including new allegations of abuse by Epstein himself.“The information gathered during this investigation is, simply, devastating,” reads Sanghavi Law Office’s report. “Despite the deep and positive connections that many individuals expressed to the investigative team regarding Interlochen, some of these same individuals detailed the significant negative impact of the conduct that they reported.”The law office’s investigative team forwarded the names of the alleged abuser to the Grand Traverse County Prosecuting Attorney’s Office, though a significant number of accused adults are now deceased, per the report. Having conducted around 180 interviews, the law office also uncovered a previously unreported allegation against Epstein.“One alum said that when she met Epstein and Maxwell at Interlochen, they offered to pay for her tuition, which they did. She noted that they withdrew financial support for subsequent schooling after she did not engage in requested conduct,” the law office’s report reads. “This alum said that during the time she interacted with Epstein and Maxwell at Interlochen, they asked her to Epstein’s lodge on campus, and that while there, Epstein engaged in sexual conduct with her, brushing against her body over her clothes, in a manner in which he indicated was accidental.”The same alum told investigators that she visited Epstein at his home in New York on three occasions while a student at Interlochen, during which Epstein would make unwanted sexual physical contact, and that she “did not tell anyone about Epstein’s conduct towards her until decades later.”In another new revelation, investigators discovered that a male faculty member at the institution had allegedly made unwanted physical advances and contact with a female student. That student told investigators that she confronted the faculty member and read aloud a letter to him: “Can you promise me that you won’t do this to anyone else?”The faculty member, according to the student, “told her that this was part of how he expressed love, and that he could not promise he would not do it again with anyone else,” the law office’s report reads.Per the report, the student informed leadership at the institution of the alleged unwanted physical contact. Within days of informing leadership, the male faculty member accused of abuse received a letter of recommendation from an institution administrator, and a second letter of recommendation from another administrator a month later.

"Kavanaugh, however, said, Well, not only is it not unconstitutional, let me suggest certain laws and other kinds of citations of tariffs that you could cite" to get around laws stopping Trump's tariffs."He was playing the staffer to Trump," Blumenthal said. "And then Trump attacked the majority on the court as fools and dogs. But then he said, 'Kavanaugh, I'm so proud of him.'"Blumenthal then pointed to Kavanaugh's "masterpiece of errors, factual revisionism and sophistry" on birthright citizenship, saying the justice built his case on speculation about what the framers of the 14th Amendment would have wanted."This is mind reading in a time machine about a non-existent legal category projected forward," Blumenthal said. Bush appointee, will now decide whether this second case should be dismissed. President Donald Trump's Department of Justice floored a former federal prosecutor after a grand jury witness blew up one of its signature cases. On Monday, reports revealed that a grand jury witness admitted the Lincoln Memorial Reflecting Pool was damaged before the prosecution of David Hearn, a former Olympic canoeist who was arrested and charged with felony damage to property after he touched some of the peeling paint in the pool. The admission undercuts the Trump administration's claims that Hearn was responsible for damaging the pool. Hearn's lawyers slammed the indictment in a letter on Tuesday, arguing that the Trump DOJ prosecutors acted improperly. Those claims caught the ear of former federal prosecutor Glenn Kirschner. He argued in a new podcast that the case seemed destined to go the same way as the prosecutions against former FBI Director James Comey, New York Attorney General Letitia James, and the Broadview Six, all of which were dismissed by judges for prosecutorial misconduct. "You may find this shocking, but Donald Trump's dirty DOJ officials, including Jeanine Pirro, may have again been involved in prosecutorial misconduct," Kirschner said. "Here they go again!" he added.
