President Donald Trump lost big at the Supreme Court on Tuesday as a majority of the justices struck down his executive order abolishing birthright citizenship in the United States — but it's possible there's an alternate reality in which he could have won this, the conservative Wall Street Journal editorial board wrote.Specifically, they argued, Trump could have tried a much less sweeping change to America's citizenship system, and gotten a more favorable result out of it."An interesting counterfactual is how the Justices might have come out on a narrower order, if Mr. Trump had tried to end birthright citizenship for transients alone," wrote the board, which has been forecasting Trump's loss on this issue for months. But instead, "he took the advice of those who recommended an expansive constitutional challenge because he thought the issue was a political winner, and his defeat is all the greater for it."With Chief Justice John Roberts issuing an absolute judgment in favor of constitutional protections for birthright citizenship, this is no longer possible without an amendment to the Constitution.A key consequence of the ruling, noted the board, is that "today’s 'Dreamers' will give birth to citizens, rather than a second generation living in limbo" — which is for the better, the board argued. "The ability to assimilate newcomers has always been an American strength, while falling birthrates will soon make that an even greater American advantage."As for the specter of "birth tourism," the board concluded, "If [it's] as big a problem as Mr. Trump says, he can make a sustained case for a constitutional amendment."

Republicans on Capitol Hill split Tuesday over how to respond after the Supreme Court rejected President Donald Trump's effort to end birthright citizenship through his Day 1 executive order, The Hill reported.In a 6-3 decision in Trump v. Barbara, Chief Justice John Roberts wrote that the 14th Amendment guarantees citizenship to nearly all children born on U.S. soil, even those born to parents in the country illegally. Roberts was joined by fellow conservative Amy Coney Barrett and the three liberal justices. Justice Brett Kavanaugh also voted to block the order but reasoned it violated a federal statute rather than the Constitution.Trump urged Congress to act by legislation, posting, "No long and unwieldy Constitutional Amendment is necessary!" But several GOP figures with legal backgrounds broke with him, saying only an amendment could do it. House Speaker Mike Johnson said the ruling means "you have to amend the Constitution to fix that." Sen. Mike Lee, a former Alito clerk, wrote, "We're going to need a constitutional amendment."Sen. Eric Schmitt said he would file legislation walking through a "door" he argued Kavanaugh's opinion left open, while also pursuing an amendment. Sen. Rand Paul pointed to an amendment he filed earlier this year. Others favored narrower steps: Sen. John Cornyn touted his bill targeting "birth tourism," and Sen. Tom Cotton called for "more deportations, a more secure border, and more prosecutions of foreign criminals."The amendment path faces long odds, needing two-thirds of both chambers and three-quarters of the states. Even some conservatives conceded it is out of reach. As commentator Megyn Kelly wrote, "It takes 38 states. We'll never get that."The court issued two other rulings on its final decision day, allowing states to bar transgender girls from girls' and women's sports and striking down limits on coordinated party spending as a First Amendment violation.

In an apparent admission of defeat, the Trump administration is dismantling the Systematic Alien Verification for Entitlements (SAVE) system, a controversial tool at the Department of Homeland Security to verify people's citizenship that they had been hoping to run every registered voter in the country through.The news was broken on X by ProPublica reporter Jen Fifield on Tuesday.It comes after U.S. District Judge Sparkle Sooknanan, a judge in Washington, D.C., who has shut down a number of President Donald Trump's extralegal schemes, issued an order further prohibiting the use of SAVE as a violation of data privacy laws."The revamped tool allowed officials to check entire voter rolls for noncitizens, using partial or full Social Security numbers," wrote Fifield, noting that prior reporting from ProPublica and the Texas Tribune "revealed that DHS had rushed it into use before it could discern voters’ most up-to-date citizenship information," with the result that "hundreds of voters had been falsely flagged as potential noncitizens."This system was integral to the SAVE America Act, the controversial legislation pushed by Trump and Republican hardliners in Congress to curtail voting rights. Among much else, the law would have required all voter rolls in the country to be checked through the SAVE database."It's unclear if that provision will survive now," wrote Fifield.In a further indignity, she noted, even with all of the false positives being flagged by the system, SAVE "hasn’t validated President Donald Trump’s repeated claims that millions of noncitizens are registered to vote" for the time it was in use.All of this comes as the SAVE America Act itself hit yet another dead end in Congress, with House Speaker Mike Johnson (R-LA) failing in his attempt to pass a rule tying it to the national defense budget bill and leaving the House floor paralyzed.
