Legal experts warned the Supreme Court's latest birthright citizenship decision fails to conclusively resolve central constitutional issues. Harry Litman, former federal prosecutor, and Melissa Murray, NYU Law professor and co-host of Strict Scrutiny, discussed the ruling's implications during a Substack Video. "They’ve done the right thing and stood up for the court’s right to citizenship, but they could have done it a year ago," Murray criticized."The second thing I will say is that it took my breath away how close this opinion was; we are one vote away from rescinding the 14th Amendment, and people should understand that for what it is," she added.In his concurrence, Justice Brett Kavanaugh suggested the 14th Amendment does not prohibit Congress from stripping birthright citizenship from children born in the U.S. to undocumented immigrants. Murray characterized Kavanaugh's statement as "an invitation for future activism and advocacy," allowing the question to remain unsettled. She warned the issue will likely resurface and advised Americans understand the precarious constitutional situation."We are not in the clear. This is not over.
