An international crime expert was floored by President Donald Trump's "quantum" trail of slush funds that he's set up during his second administration. Jonathan Winer, a former State Department official who investigated international money laundering cases, said during a new episode of the "Court of History" podcast on Wednesday that Trump's slush funds appear quantum in nature because "you never know where [they're] going to end." He referred to the $1.776 billion "anti-weaponization fund," the U.S.-controlled fund in Qatar established to hold money from Venezuelan oil sales, the so-called Board of Peace, and the America 250 celebration, which is being organized with private donations, and Trump's ballroom. On top of all that, Winer noted that Trump's Department of Justice just gave him immunity from tax cases as part of a settlement over a 2019 case involving the president's leaked tax returns. That settlement has been valued at roughly $100 million, according to public reports."It's really quite remarkable," Winer said. Winer added that there are instances in which Trump used existing federal structures to create slush funds, even those not designed to operate that way. The silver lining, according to Winer, is that there are documentable ways to find out what Trump has been up to. For instance, there will be shipping logs and bank records that correspond with the oil sales. There will also be ways for a future Congress to trace donations to the Board of Peace and other entities controlled by Trump, Winer said. The problem future lawmakers may face is enforcing the laws against Trump if he can prove the money was connected to official activity, Winer added. "Congress has absolute right to investigate it, but the problem is enforcement," he said. "There's no penalty at this point. There's no such thing as contempt of Congress for the president and, on this, no one can go after him criminally if he stole all the money in connection with official activity. So it's essentially impeachment and removal for him."

But Justice Department officials have revealed it's not actually dead — just under wraps.According to The Atlantic, eight Trump administration insiders "said that Justice Department officials and people close to the White House have indicated that the payout idea has not actually been scrapped. Rather, they say, officials are exploring whether elements of the fund can be reactivated while also examining alternative arrangements to make sure loyalists get compensated."These officials said the plans to pay off Trump allies on the side are "being kept quiet while the Trump administration waits for opposition to the fund to blow over," and particularly until Todd Blanche has been confirmed as attorney general permanently, out of fear a handful of maverick Republicans like Sen. Thom Tillis (R-NC) could block the process.One proposal for how it would work would be that the same people who would have applied to the "Anti-Weaponization fund" would simply file lawsuits against the administration, which the DOJ would then quickly settle and pay out through other existing compensation funds.All of this comes after Senate Republicans decided against including language limiting the fund in their reconciliation package to fund immigration enforcement, using the justification that the administration had agreed not to move forward with the fund.It also comes as a federal judge in Washington, D.C., declined to issue a temporary restraining order blocking the fund for the same reason — but warned the Justice Department not to "play possum" with the fund and enact it through other means.

Will Congress Renew Controversial Surveillance Law? Electronic Frontier Foundation's Cindy Cohn

A key provision of the Foreign Intelligence Surveillance Act is set to expire Friday unless it is reauthorized by Congress. Section 702 allows for the warrantless surveillance of foreign nationals believed to be outside of the U.S., yet, in practice, it also sweeps up and stores vast amounts of data from people inside the country, including their emails, texts and cellphone data. The FISA provision was enacted in 2008 to legalize George W. Bush’s warrantless wiretapping program that was developed after 9/11. A bipartisan group of senators is opposing the reauthorization of Section 702 due to President Trump’s naming of MAGA loyalist Bill Pulte as acting director of national intelligence, to replace Tulsi Gabbard, who announced her resignation in May. Pulte has no known background in intelligence. He currently serves as director of the Federal Housing Finance Agency, where he has used his position to carry out Trump’s campaign of retribution against his political enemies. “It took this nomination of a completely unqualified guy to get enough members of Congress to really stop [Section 702],” says Cindy Cohn, executive director of the Electronic Frontier Foundation. “It’s time to take a look and listen hard about the privacy protections that are needed, at a minimum, for this program to go forward.” Cohn notes that the “massive national security surveillance state that was built after 9/11 has always been a threat to freedom.”
