A Department of Justice lawyer was forced to eat his own words after boasting about getting New Jersey's voter rolls then failing the next day.On Wednesday, a federal judge dismissed a DOJ case seeking New Jersey's unredacted voter rolls. The decision gave the Trump DOJ its 18th straight defeat in court when it comes to its nationwide effort to grab state voter rolls.However, Democracy Docket noted in its coverage of the decision that the DOJ's loss was made more ironic by one of its attorneys boasting the day before that it would secure New Jersey's voter rolls.The boast came after a software glitch led to thousands of noncitizens being mistakenly added to the rolls. The DOJ argued that New Jersey had to hand over its voter rolls because of the error.However, New Jersey Gov. Mikie Sherrill (D) refused the DOJ and wrote in a post on X that "New Jersey will not provide the personal information of thousands of New Jersey residents," along with a copy of a letter to Assistant Attorney General Harmeet Dhillon saying as much."The request had no legal basis," Sherrill added. "I will always protect New Jerseyans' personally identifiable information."DOJ Attorney Jesus Osete, who describes himself on his profile as Dhillon's number two, responded to Sherrill with a post of his own. "Challenge accepted," Osete's post read.The next day, U.S. District Judge Zahid Quraishi, a Biden appointee, answered that challenge by throwing out the DOJ's case, Democracy Docket noted.Quraishi even noted that the software glitch had "no bearing" on whether the DOJ had a right to voter rolls.

President Donald Trump has made it clear that he plans on rigging the 2026 midterm elections, from delivering a speech touting unsubstantiated claims of meddling in the 2020 presidential election and trying to purge people from the voter rolls to attempting to thwart mail-in balloting and potentially firing the House of Representatives Clerk for not being sufficiently compliant.Yet he has been 0 and 18 in the courts, with the latest defeat being notable because it involves a case in which non-citizens were proven to have voted.“President Donald Trump’s Department of Justice (DOJ) suffered its 18th defeat, with no wins, in its nationwide voter data crusade Wednesday, when a federal judge dismissed the department’s lawsuit seeking New Jersey’s unredacted voter rolls,” reported Democracy Docket's Yunior Rivas on Wednesday.Rivas added, “U.S. District Judge Zahid Quraishi wrote that the error had ‘no bearing’ on whether DOJ had a right to the voter rolls.” The reporter pointed out that “in his ruling, Quraishi granted New Jersey’s motion to dismiss and denied DOJ’s motion to compel the records, ruling that the Civil Rights Act of 1960 does not give the federal government access to the state’s live voter registration database.”Rivas continued, “The dismissal with prejudice prevents DOJ from refiling the same claim in the district court, though the department can appeal, as it has almost every other loss.” They also pointed out that “New Jersey had already provided DOJ with its publicly available voter list.”In his decision, Judge Quraishi pointed out that “the Constitution's architects chose to delegate election administration to the states, recognizing that local governments have the deepest understanding of their constituents' circumstances.” Later, quoting the Massachusetts Convention’s 1788 debates about the Constitution, the judge added that “the Framers of the Constitution chose to embrace balance in crafting the Elections Clause. The diffusion of power between state and federal government was intended to ‘preserve and restore to the people their equal and sacred rights of election [against] the influence of ambitious or popular characters, or in times of popular commotion, and when faction and party spirit run high.’”Trump’s latest gambit was prompted by news that New Jersey accidentally added roughly 6,600 noncitizens to the state’s voter rolls through a glitch in its DMV software, with roughly 400 actually casting ballots in 2023 and 2024 elections.Trump's 0-18 court record on voter data demands reflects a broader pattern of judicial rejection of his election-related claims. Legal experts argue that Trump's DOJ is using the noncitizen voting issue—which affects less than 0.01% of votes cast—as a pretext to gain access to voter databases that could enable partisan purges. Constitutional scholars note that the Framers intentionally distributed election authority between states and the federal government to prevent exactly this type of centralized manipulation. Despite repeated legal defeats, Trump's administration continues filing similar suits, suggesting the litigation is less about addressing actual election fraud and more about creating a veneer of legitimacy for undermining state election administration.

New Don Lemon court filing alleges federal officer lied to the judge

A new court filing from ex-CNN host Don Lemon was filed Wednesday, alleging that a Department of Homeland Security officer lied under oath in a statement to the judge in his case. Lemon is included with several other journalists charged by the Department of Justice, which claims that Lemon and other reporters were protesting when they were filming at a Minnesota church where one of the pastors was coordinating with immigration agents. National security expert Marcy Wheeler noted that this is the second time the Justice Department has asked Judge Douglas Minko to accept a complaint from an ICE agent who watched the video of the church broadcast and testified to what was in it. According to Lemon's filing, the agent made false claims about the journalists joining in the chanting from protesters. "That sworn allegation about Mr. Lemon was false," the filing states. "The government did not produce the draft complaint affidavit until July 17, 2026. At the July 24 hearing, the government explained that it submitted the affidavit to the Court in late January, but the Court did not sign it. The government then 'took Chief Judge Schiltz's advice' and obtained a grand jury indictment on January 29, 2026. Thus, only two days before securing the indictment, the government submitted a complaint affidavit falsely alleging that Mr. Lemon and the other journalists joined in the chanting. The timing strongly suggests that the government presented the same false account of the journalists' conduct to the grand jury."On Friday, in a rare move, Judge Minko ordered that the Justice Department turn over all testimony and evidence presented to the grand jury at the time. Their specific request is to find whether this sworn statement and any others were used to secure a grand jury indictment.The proceedings for a grand jury are typically kept secret, but in recent events, judges have allowed that information to be released to the defense in trial courts. In a recent Chicago case, the Justice Department was found to have misled the grand jurors and even dismissed jurors that they felt wouldn't give them the indictment they sought. That case involved six political leaders and activists protesting outside of an ICE facility in Broadview, Illinois. The charges have been dropped and the accused have asked for a special counsel to investigate the incident. Judge Minko said that he wanted to examine the information himself first. However, Matthew Ebert, who represents freelance journalist Georga Fort, said that the government has made false claims about his client already, including in sworn affidavits, Minneapolis Public Radio reported last week. “The presumption of regularity has collapsed,” Ebert said.Justice Department prosecutor Neville Hedley told the judge that no false information in earlier documents made it into the indictment. That doesn't indicate whether the information was revealed to the grand jury to obtain the indictment, however. “These were not material falsehoods," Hedley said. “This was a mistake, this was a miscommunication.”The affidavit signed by DHS-ICE Special Agent Timothy Gerber reads, "Broadcast video obtained from Cities church also shows ARMSTRONG, ALLEN, LEMON, RICHARDSON, KELLY, FORT, LUNDY, CREWS chanting with agitators and obstructing parishioners' path of travel."Hedley didn't indicate what was "miscommunicated" in the claim. Lemon and his attorneys have alleged that the case against him and the journalists is "weak."
